As you may have guessed from exploring this website, we provide Digital Services of Engineering Drawing, Graphics Design & Digital Marketing.
Agreement to Terms
- By purchasing or engaging with our services, you accept these terms of service in their entirety.
- If you do not agree with any part of these Terms, you should refrain from using our services.
Client Responsibilities
- You agree to provide all necessary information, materials and communications necessary to complete your project.
- This includes logos, images, brand guidelines and written content
- It is your responsibility to ensure that you have the rights to use any materials provided to us.
Payments & Subscriptions
- All projects require an advance payment to commence work, usually 70% of the total project cost
- The final remaining payment is required after the agreed work is completed, and the work is then submitted to you in the source file format. Payments are accepted through Cash, Bank Transfer & UPI.
- It is your responsibility to ensure that you have the rights to use any materials provided to us.
- The MSMED Act of 2006 addresses delayed payments to micro, small and Medium Enterprises (MSMEs) by mandating buyers to make payments within 45 days of accepting goods or services, imposing a compounded interest penalty if payments are delayed, and establishing Micro and Small Enterprise Facilitation Councils (MSEFCs) to resolve disputes.
- Late payments after 45 days will be subject to a 20% charge on the bill amount
Project Time
- The time frame for completion of the project will be mutually agreed upon before the work is started.
- The completion time may vary depending on the scope of the project, the responsiveness of the client and any unforeseen delays.
- We will keep you informed of the progress of the project and notify you of any expected delays.
Revisions
- Our services include 02 rounds of iterations during the design process.
- Additional revisions or changes to the scope of work may incur additional fees.
- We will request your approval after each iteration before moving on to the next stage.
Copyright and Ownership
- Upon receipt of full payment, the final design files will become your property.
- We reserve the right to use your completed project in our portfolio or for promotional purposes, unless you request otherwise in writing.
- You may not resell, sublicense, or claim our designs as your own without our prior consent.
Privacy
- We understand the importance of privacy. Unless required by law, any material provided to us will not be shared with third parties without your consent.
Cancellations and Refunds
- If you wish to cancel a project, please let us know as soon as possible.
- Cancellations made after work has begun may be subject to a cancellation fee.
- No refunds will be given for work completed up to the point of cancellation.
Limitation of Liability
- We will not be liable for any damages, losses or liabilities arising out of or in connection with the use of or inability to use the design files provided, including any indirect or consequential damages.
- Our liability is limited to the total amount paid for a particular project.
Indemnification
- You agree to indemnify and hold Ketan Designs, its affiliates and employees harmless from any claims, damages or legal action arising out of or in connection with the use of Ref. designs, content & Images provided by you that infringes the rights of third parties.
- These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be resolved in the competent courts of nashik district.
- We reserve the right to update or revise these terms of service at any time.
- We will notify you of any material changes by email or through our website. It is your responsibility to review the Terms periodically for any updates.
